As a business person (either as an owner-operator or as an experienced professional), you may be able to apply under one of Canada’s four streams if you can demonstrate that you meet requirements for a minimum net worth and can present enough investment capital to buy or establish a business.

Start-Up Visa Investor Program

Start-up visa is a federal Government of Canada immigration program which can be suited for you if you have an entrepreneurial spirit and drive. Whether you are an investor or inventor, and if you meet the initial eligibility, you can receive permanent residence through this program.  The selection criteria among other things includes the following:

  • you must have a qualifying business
  • you must get a letter of support from a designated organization
  • you must pass a language assessment
  • you must demonstrate that you have sufficient funds to settle in Canada
  • you must not have the intention to live in Quebec

A qualifying business is one that you have created with a designated organization in which you hold a minimum of 10% of the voting rights shares attached to all shares in the business corporation. Also, you and the designated organization, jointly hold more than 50% of the total voting rights attached to all the shares.

Additionally, the business must be incorporated in Canada, have essential part of the business operation that takes place in Canada, and has active and ongoing management of the business from within Canada.

A designated organization can be an angel investor, venture capital fund, or a business incubator. Additionally, you must qualify for one of the requirements where a designated organization must make the following investment into your business:

  • one angel investor or more must invest a minimum of $75,000 into a qualifying business
  • a venture capital fund must invest a minimum of $200,000 into a qualifying business
  • a business incubator must accept you and your business idea as an applicant into their business incubator program
  • you must present a language ability that meets or exceeds a level 5 set for the Canada language benchmark

Funds will depend on your family size, and in general, a family of four people must have at least $24,733.

Self-Employed Person Program

Self-employed person visa is a federal Government of Canada immigration program that is suited to those who have an entrepreneurial spirit and experience. This program is right for artists and athletes, and is subject to a selection criterion which includes the following:

  • must have 2 years experience in the last 5 years either in cultural or athletic activities
  • must be willing to be self-employed
  • must attain minimum points on a 35-point scale for experience, education, age, languageability, and adaptability
  • must be admissible in Canada

Provincial Nomination Business Programs

There are several business immigration programs available through the provincial nomination pathways. Each province has its own selection criteria, but, generally, an applicant must meet the following:

  • you must establish or purchase a qualifying business
  • you must meet or exceed minimum net worth requirements
  • you must make a minimum investment into the business
  • you must create a minimum number of paid positions for either Canadian citizens or permanent residents
  • you must be admissible in Canada

The provincial nomination business program generally requires an express of interest, and if you are selected, you will receive a work permit for a period of 1 to 2 years, during which you must establish or purchase your business.

Once you have completed the program requirements, you can then apply for permanent residence through the Government of Canada.

Corporate Immigration Programs

If you have a business in operation and would like to establish a presence in Canada, you may be able to get a labour market impact assessment (“LMIA”) exempt intra-company transfer work permit. This program is for those people who are thinking of branching out to the Canadian market and are interested in establishing their business first.

There are also options available for investors or business operators to apply for a LMIA work permit to come to Canada and work as a self-employed person. This program willallow you to come to Canada on a work permit, andeither purchase or establish a new business.
