Procedural Fairness Letters

visitor-visa

Have you applied for permanent residence application, a study permit, visitor visa, or a work permit and received a procedural fairness letter? (“PFL”) This is nothing to be alarmed about. But if you chose to not respond to the letter, the outcome of your application(s) can be negative and your application(s) may be denied.

A PFL is an opportunity for you to tell Immigration, Refugee and Citizenship Canada (“IRCC”) your side of the story regarding an issue that is of concern to IRCC. Typically, PFL can be issued for a number of reasons, but commonly these may be issued in the following circumstances:

  • inadmissibility (criminal, medical, or financial)
  • you didn’t live in Canada for 730 days in the past 5 years
  • fraud or misrepresentation
  • Security of Canada
  • your application was incomplete and IRCC has concerns

If you have received a PFL, it is highly recommended that you speak with our Canadian immigration lawyer. He has an extensive and proven record in dealing with difficult cases, and he can help you present a strong case to IRCC.

If you choose to ignore or fail to properly respond to PFL, you may face not only your application being refused, but you could be banned from applying for permanent residence to Canada for a period of 5 years.
